Govt to take decision on Badal Farazi’s release: HC

The High Court on Wednesday rejected a writ petition seeking directives for releasing Badal Farazi, who served 10 years in India's Tihar jail in a murder case with observation that the government will take decision on the matter.

The two-member HC bench of Justice JBM Hasan and Justice Md Khairul Alam rejected the petition considering that the petition was not placed properly.

The court said as the government has brought him back, it will also decide about his release, and the court should not issue any directive in this regard.

On Tuesday, the court fixed Wednesday (today) to pass an order after hearing a writ petition filed on July 8 seeking a directive to government over Farazi’s release.

Barrister Humayun Kabir and Barrister Kawser stood for the petitioner while Deputy Attorney General Masud Hasan Chowdhury Porag for the state.

After serving in Indian jail for 10 years in a murder case, Bangladeshi youth Badal Farazi was brought back home on Friday (July 6) under a bilateral treaty on 'Transfer of Sentenced Prisoners'.

Indian police were looking for one Badal Singh on charges of killing an old woman at Amar Colony in New Delhi on May 6, 2008. When Badal Farazi was entering India on a tourist visa on July 13, 2008, he was arrested for the similarity of his name with that of an accused in a murder case.

Later, he was sentenced to life term imprisonment in the case.

Badal's life sentence was upheld by the Delhi High Court in May 2016, and his appeal against it was rejected by the Indian Supreme Court in December the same year.

Now, he has been kept in Keraniganj Central Jail.unb.
