BNP struggles to find ways for Khaleda’s  release

The BNP is still unable to find a clear way to free party chairperson Khaleda Zia from jail, though she has already passed 37 days in the old central jail at Nazimuddin Road in the Zia Orphanage Trust graft case. The former prime minister, who obtained bail in the case, has to be produced before a Comilla court on March 28 and face charges of an arson attack on a bus during the 2015 anti-government movement.

Besides, an appellate division is set to hear a petition before the Supreme Court to vacate its stay order on the High Court ruling, which granted her four-month bail in Zia Orphanage Trust Corruption case.

Talking to The Independent, senior party leaders accused the government of delaying the bail of Khaleda through various machinations out of political vengeance. If the government wants, it can prolong the bail of the chairperson. In that case, they would have to continue the legal battle and peaceful agitation on the streets for her release, they said.

Khaleda’s lawyers are, however, hopeful about her release on bail through legal battle.

They expect that the appellate division would vacate the stay order on the HC ruling, granting her four months' bail and they would move for her bail in the Comilla case before her appearance there.

BNP standing committee member, Dr Khandaker Mosharraf Hossain, said the chairperson’s bail is being prolonged through different machinations at the hint of the government.

The government can delay her bail if it wants, but it would have serious consequences,” he said.

The elderly leader further said resorting to machinations to prolong the bail of the former premier would only tarnish the image of the government.

He claimed that sending her to jail in a fabricated case and prolonging her bail proved that the government has done it out of political vengeance. The former minister said they would continue the legal battle along with peaceful political action, demanding the release of their leader on bail.

Khaleda’s lawyer, Advocate Khandaker Mahbub Hossain, termed the case of sending Khaleda to jail for five years and prolonging her bail an exceptional one. He also said that the bail is being prolonged only due to political reasons, which was unexpected.  Mahbub, also a vice-chairman of the BNP, said law says Khaleda should be released soon on bail, but if there is an autocrat it may be prolonged further.

 He expects that the appellate division would vacate the stay order since getting bail is usual for those who are sentenced to up to five years.  Replying to a question, he said they would move for Khaleda’s bail in the Comilla case before March 28.  Khaleda has been accused of an arson attack on a bus on February 3, 2015. Eight people were killed.  On February 8, the Special Judge’s Court-5 of Dhaka sentenced Khaleda to five years’ rigorous imprisonment in the graft case.

 The court also jailed her elder son Tarique Rahman, now acting chairman of the BNP, and four others to 10 years’ jail and fined them Tk. 2.1 crore, saying all the six convicts would have to pay the fine in equal amounts.
