Khaleda moves to SC against HC verdict

Zia Orphanage Trust graft case
STAFF REPORTER, Dhaka
Khaleda moves to SC
against HC verdict

BNP chairperson Khaleda Zia has filed a leave to appeal petition before the Supreme Court (SC), challenging the High Court (HC) verdict that enhanced her punishment from five years to 10 years' imprisonment in the Zia Orphanage Trust graft case. In the petition, the BNP chief prayed to the apex court to suspend her punishment, grant her bail, as well as a stay order on the effectiveness of her punishment in the case.

Khaleda Zia's lawyer, Kaisar Kamal, filed the petition before the related branch of the Supreme Court on Wednesday.

The Appellate Division is yet to fix any date for hearing the petition. Barrister Kaisar Kamal yesterday (Thursday) told reporters: "The lower court sentenced Khaleda Zia to five years in jail in the case, but the HC unfairly passed an order enhancing the jail term. So, we filed an appeal petition seeking her bail and stay order on the effectiveness of her punishment."

On January 28, the HC released the full text of its verdict doubling the jail term of Khaleda Zia in the graft case to 10 years from five.

On October 30, 2018, the HC bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman extended the BNP chief’s jail term.

On February 8, 2018, a special court convicted Khaleda Zia and sentenced her to five years' imprisonment in the Zia Orphanage Trust graft case.

Five other accused in the case, including her son and BNP senior vice-chairman Tarique Rahman, were sentenced to 10 years' imprisonment each. The court also fined the five accused Tk. 2.10 crore each.

On March 12 last year, the BNP chief secured four months' bail from the HC in the case and moved the court challenging her conviction on February 19.

The Anti-Corruption Commission (ACC) had sought extension of her jail term to life imprisonment.

The ACC filed the case against Khaleda and others in Ramna police station on July 3, 2008, accusing them of misappropriating Tk. 2.1 crore in donations meant for a trust set up in her husband’s name.

The former prime minister was sent to jail on February 8, 2018, after being sentenced by a special court that day.
