HC seeks updated medical report

The High Court (HC) yesterday directed the authorities concerned to submit before it an updated report on the medical treatment of Bangladesh Nationalist Party (BNP) Chairperson Khaleda Zia by 5.00pm on Wednesday. The HC asked Bangabandhu Sheikh Mujib Medical University (BSMMU) Vice-Chancellor (VC) Prof. Kanak Kanti Barua to submit the medical report on Khaleda’s treatment by providing details in three categories on whether the BNP chief has given her consent to receive advanced treatment in line with the medical board’s recommendations.

If she has given her consent to receive advanced treatment, whether the BSMMU authorities have started her treatment and the present condition of her health, enquired the HC order.

The HC bench, comprising Justice Obaidul Hassan and Justice AKM Zahirul Huq, came up with the orders while hearing a fresh petition filed by the BNP chief seeking bail in connection with the Zia Charitable Trust corruption case.

Khaleda’s latest medical report to the Supreme Court (SC) registrar general by 5.00pm on Wednesday without failure. It also fixed Thursday for holding a hearing on Khaleda’s bail petition.

Earlier on February 18, Khaleda, who is now in the prison cell of the BSMMU for treatment, filed the petition with the HC seeking bail in the Zia Charitable Trust corruption case to receive better treatment in London.

During yesterday’s hearing, Khaleda’s lawyer Advocate Zainul Abedin told the court that since December 12, 2019, the BNP chairperson’s health condition has been deteriorating day by day. She is now seriously ill and cannot move freely without the help of others. She cannot even take food or medicines on her own, he added.

He also said his client needs advanced treatment and therapy. Therefore, she has filed this application for bail on a new ground of illness to seek modern advanced therapy-based treatment abroad.

As such, the senior lawyer noted, the petitioner wants to avail advanced treatment in the UK after securing bail from the court. He also prayed to the court for granting Khaleda’s bail on health and humanitarian grounds.

Attorney General Mahbubey Alam opposed his submission. He told the court that the HC had earlier rejected a similar bail petition of Khaleda and the Appellate Division (AD) has also upheld the rejection order.

The BNP chief has filed the petition with the HC only for the sake of filing a petition as there is no new ground included in the petition. It was filed for nothing, but to embarrass the court, the chief lawyer of the state asserted.

On August 8, 2011, the Anti-Corruption Commission (ACC) filed the Zia Charitable Trust graft case with the Tejgaon police accusing four persons, including Khaleda, of abusing power in raising funds for the Trust from unknown sources.
